Terms of Service (ToS)

J&L Hosting ("The Company") agrees to furnish services to the Subscriber, subject to the following ToS (Terms of Service).

Use of J&L Hosting Service constitutes acceptance and agreement to J&L Hosting's AUP (Acceptable Use Policy) as well as J&L Hosting's TOS (Terms of Service).

All provisions of this contract are subject to the ToS (Terms of Service) of J&L Hosting and AUP (Acceptable Use Policy). The AUP may be changed from time to time at the discretion of the Company. Subscriber understands that change to the AUP by the Company shall not be grounds for early contract termination or non-payment.

This Agreement shall be construed in all respects in accordance with the laws of Greece.
  1. Disclosure to Law Enforcement: The AUP specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition J&L Hosting shall have the right to terminate all service set forth in this Agreement.

  2. Service Rates: Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that the Company may prospectively change the specified rates and charges from time to time.

  3. Payment: Establishment of this service is dependent upon receipt by the Company of payment of stated charges within 5 days. Subsequent payments are due on the anniversary date of the month for that month's service, except for Parallels licenses that must be paid for one day earlier, due to the way they are managed.

  4. Payments and Fees: Service will be suspended on hosting accounts that reach 5 days past due. All hosting accounts that reach 15 days past due are terminated and all files related to that account are permantently deleted. Third party products, such as (but not limited to) domain names, SSL certificates, control panel licenses are suspended on the day the invoice is due.

  5. Money Back Guarantee: The thirty-day (30) money back guarantee starts from the date of the purchase of the account as reflected on your receipt/invoice. The money back guarantee applies only to hosting accounts (shared, reseller, VPS, SHOUTcast). The money back guarantee does NOT apply to domain name registrations. Domain name registrations cannot be UNDONE. So make sure you check the domain name you wish to register before you proceed to make a payment. If you received a domain name for free as part of a promotion with your web hosting package, and then you cancel your account, a €25 fee (not including VAT taxes where applicable) will be applied to compensate J&L Hosting the price of the domain name registration. Furthermore, the money back guarantee does NOT apply to third party products, such as - but not limited to - control panel licenses, SSL certificates and software. The money back guarantee is automatically invalid when a hosting account has been suspended and/or terminated due to violation of the Terms of Service and/or Acceptable Use Policy.

  6. Refund and Disputes: All payments for domain name registrations, SSL certificates, control panel licenses and software (third party products) are nonrefundable regardless of usage. All overcharges or billing disputes must be reported within 10 days of the time the dispute occurred. If you dispute a charge to your credit card issuer that, in J&L Hosting's sole discretion is a valid charge under the provisions of the ToS and/or AUP, you agree to pay J&L Hosting an "Administrative Fee" of €100 (not including VAT taxes where applicable). No refunds may be requested for hosting accounts that have been suspended and/or terminated due to the violation of the Terms of Service and/or Acceptable Use Policy.

  7. Failure to Pay: The Company may temporarily deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not relieve Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.

  8. Account Cancellation: Requests for canceling accounts may be made in writing with at least 30 days notice but not more than 60 days prior written notice and sent by email to info@jlhosting.net. You must have all account information to cancel. When accounts are cancelled by the customer or automatically, all payment subscriptions (with Paypal or other service) are not cancelled automatically. It is the customer's responsibility to manually cancel them. Any automatic payments received by J&L Hosting after a service has been cancelled are credited to the customer's account, can be used in the future to buy our services and are non refundable.

  9. Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

  10. New Domain Accounts: All new webhosting accounts involving new domains will be set up and entered into our accounts within 7 business days. If the new domain is registered by the account holder, there will be no handling fee.

  11. Transfer of Domains: Due to the unpredictable nature of the transfer process, no guarantees are made regarding the amount of time a specific transfer may take. If the transfer of the domain is done by J&L Hosting on behalf of the account holder a handling fee may be incurred. If the customer cancels service during the transfer period for any reason, all charges are considered earned.

  12. Support Boundaries: J&L Hosting, provides 9-5 Monday-Friday technical support to our subscribers. We limit our technical support to our area of expertise. The following is our guidelines when providing support: J&L Hosting provides support related to your accounts initial setup. J&L Hosting does not offer tech support for application specific issues such as cgi programming, html or any other such issue. J&L Hosting does not provide technical support for YOUR customers. We encourage you to email support@jlhosting.net for assistance. Please first check our FAQ's and help files in the program that you are using. They may have the answer to your question so please do investigate these resources before contacting tech support. We do not provide support for Parallels licenses.

  13. SPAM and Unsolicited Commercial Email (UCE): J&L Hosting takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of J&L Hosting may not use our resources to transact in UCE. Customers of J&L Hosting may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. In addition, it is not acceptable to transmit bulk email through remote SOCKS, HTTP or other similar proxies who in turn make a SMTP (TCP port 25) connection to the destination mail servers. This technique may result in account suspension or termination. Violations of this policy carry severe penalties, including termination of service. In order to prevent unnecessary blacklisting due to spam we reserve the right to occasionally sample bulk email being sent from servers.

    1. Violation of J&L Hosting's SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, J&L Hosting will initiate an immediate investigation (within 48 hours of notification). During the investigation, J&L Hosting may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, J&L Hosting may, at its sole discretion, restrict, suspend or terminate customer's account. In such cases, refunds are not possible and the money back guarantee is invalid. Further, J&L Hosting reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. J&L Hosting will notify law enforcement officials if the violation is believed to be a criminal offense.

    2. As our Customers are ultimately responsible for the actions of their clients over the J&L Hosting's resources, it is advisable that Customers develop a similar, or stricter, policy for their clients.

  14. Network

    1. Bandwidth and Disk Usage: Customer agrees that bandwidth and disk usage shall not exceed the number of megabytes per month for the Services ordered by Customer on the Order Form (the "Agreed Usage"). J&L Hosting will monitor Customer's bandwidth and disk usage. J&L Hosting shall have the right to take corrective action if Customer's bandwidth or disk usage exceeds the Agreed Usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services, or termination of this Agreement, which actions may be taken is in J&L Hosting's sole and absolute discretion. If J&L Hosting takes any corrective action under this section, Customer shall not be entitled to a refund of any fees paid in advance prior to such action.

    2. System and Network Security: Users are prohibited from violating or attempting to violate the security of the J&L Hosting servers. Violations of system or network security may result in civil or criminal liability. J&L Hosting will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:

      1. Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access.

      2. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.

      3. Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing".

      4. Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.

      5. Taking any action in order to obtain services to which such User is not entitled.

  15. Notification of Violation:

    1. J&L Hosting is under no duty to look at each customer's or user's activities to determine if a violation of the AUP has occurred, nor do we assume any responsibility through our AUP to monitor or police Internet-related activities.

    2. First violation: Any User, which J&L Hosting determines to have violated any element of this Acceptable Use Policy, shall receive an email, warning them of the violation. The service may be subject at J&L Hosting's discretion to a temporary suspension pending a User's agreement in writing, to refrain from any further violations.

    3. Second Violation: Users that J&L Hosting determines to have committed a second violation of any element of this Acceptable Use Policy shall be subject to immediate suspension or termination of service without further notice.

  16. Suspension of Service or Cancellation: J&L Hosting reserves the right to suspend network access to any customer if in the judgment of the J&L Hosting network administrators the customer's account is the source or target of the violation of any of the other terms of the AUP or for any other reason which J&L Hosting chooses. If inappropriate activity is detected, all accounts of the Customer in question will be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer's accounts were suspended.

  17. J&L Hosting reserves the right to amend its policies at any time. All resellers and managed servers of J&L Hosting must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate Cancellation. You will be held responsible for the actions of your clients in the matter described on these Terms and conditions. Therefore, it is in your best interest to implement a similar or stricter Terms and conditions or otherwise called Acceptable Terms of use policy.

  18. Indemnification: J&L Hosting wishes to emphasize that in agreeing to the J&L Hosting's Acceptable Use Policy (AUP) and Terms of Service (ToS), the customer indemnifies J&L Hosting for any violation of the Acceptable Use Policy (AUP) and Terms of Service (ToS) that results in loss to J&L Hosting or the bringing of any claim against J&L Hosting by any third-party. This means that if J&L Hosting is sued because of a customer's or a customer of a customer's activity, the customer will pay any damages awarded against J&L Hosting, plus all legal fees assumed by J&L Hosting.

  19. Miscellaneous Provisions: You must provide us with, and keep current, good contact information for you. E-mail, fax, and telephone contacts are used, in that order of preference.

    1. A waiver by the Company of any breach of any provision of this Agreement by Subscriber shall not operate as or be construed as a continuing or subsequent waiver thereof of any breach of any other provision thereof.

    2. Subscriber shall not transfer or assign this Agreement without the prior written consent of the Company. Company may assign Agreement at anytime without consent from or notice to Subscriber. Company reserves right to cancel customers rights under this contract at anytime without further obligation.

    3. J&L Hosting takes no responsibility for any material input by others and not posted by J&L Hosting. J&L Hosting is not responsible for the content of any other websites linked to the J&L Hosting Network; links are provided as Internet navigation tools only. J&L Hosting disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy.

    4. J&L Hosting is not responsible for any damages your business may suffer. J&L Hosting does not make implied or written warranties for any of our services. J&L Hosting denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by J&L Hosting.

    5. It is absolutely forbidden to host pornographic content or IRC servers on any of our servers. If customer is found hosting this material, the customer will be subject to immediate cancellation without refund.

  20. Responsibility for Content: You, as J&L Hosting's customer, are solely responsible for the content stored on and served by your J&L Hosting account.

  21. Free web hosting: Free web hosting accounts will be provided from time to time, at J&L Hosting's sole discretion. Such accounts are subject to all the Terms herein. Each free account is a three month valid service, which may be automatically renewed by J&L Hosting. If, for some reason, a free account is not to be renewed, the account holder shall be notified in advance. Each individual is entitled to one and only one free web hosting account. If an individual is found to hold two or more free web hosting accounts, J&L Hosting may suspend or terminate some or all such accounts, without prior notice.

  22. Please make sure you have read and fully understand the following before placing an order for any Parallels license:
    1. All sales involving Parallels licenses are final
    2. No refunds are possible for Parallels licenses (and for any other third party products)
    3. Parallels Plesk for Virtuozzo licenses are only intended to be used in Virtuozzo powered VPS servers. They will not work in any other environment (such as OpenVZ, VMWare etc).
    4. Please make sure that you order any addons you need along with the license itself. If you wish to order an addon at a later time, you can create a support ticket with us and we will guide you through the process. However, please keep in mind that when addons are added after a license has been issued, the license is revoked, a new one issued and any full months remaining in the old license are refunded. This means that in the case of monthly licenses, no refund is possible and you essentially have to pay for the license again.
    5. The Plesk for Windows license does not include the MSSQL tools by default. You will have to order the Power Pack addon too if you need to be able to manage MSSQL databases through Plesk.

Privacy Policy

Your right to privacy is an important concern to us and we wish to protect the privacy of the personally identifiable information you share with us. We also believe it is important to inform you about how we will use your personal data, and to give you choices about how your data will be used. Therefore, we encourage you to read this Privacy Policy carefully.

We only use the information which is provided through our site to help us improve our services to you, to provide you with the products you have requested, to inform you about additional products or services that may be of interest to you, for marketing purposes and for other operational and internal purposes. Other than as described, J&L Hosting will not sell, trade or rent your personal information.

J&L Hosting will only collect your personal information (such as your name and contact details, including a valid email address) if you provide it voluntarily. If you do not want this information to be collected by us, please do not submit it. We will never pass any of these details on to any other party unless legally compelled to do so, and we will not retain your personal information longer than is necessary for the purpose for which it is collected.

In addition, while using our site we automatically track certain information about you using our own systems and that of trusted third party analytics providers. This information includes the URL that you just came from (whether this URL is on our site or not), which URL you go to next (whether this URL is on our site or not), details of the device and browser you are using, your IP address and how you interact with our site. Many sites automatically collect this information and use this data to improve their functionality and services.

We also employ the use of cookies to assist us in this process. A cookie is a small piece of computer code that enables web servers to identify users. Cookies do not store any information that you have provided to our site. They are simply identifiers. You can delete cookie files from your hard drive at any time or avoid cookies by configuring your browser to reject them or to notify you when a cookie is being placed on your hard drive.

All our payments are processed via 3rd party payment gateways, such as Paypal. We do not hold any credit card details ourselves.

In the event that J&L Hosting is merged with or acquired by another organisation, or if we go out of business, enter into administration or go through some other change of control, your Content or Personal Data may be one of the assets transferred to or acquired by a third party.

We may, from time to time, send all registered users a newsletter, but you have to explicitly opt-in for this while registering and may opt out of this at any point. We will not send more than one newsletter a month and our newsletters will not contain any 3rd party advertisements.

Once registered on our website, you may automatically receive from J&L Hosting a number of different emails which may contain further information, reading materials, and links that will help you get started. Here is a summary of what you can expect:

  • Account creation confirmation message
  • Service provisioning confirmation message(s)
  • Upcoming service expiry notification(s)
  • Other transactional messages concerning your account and/or services
  • Important notifications concerning scheduled maintenance to our services and/or service interruption
